Buyer Agreement
By proceeding with the purchase on Homebourse, you agree to the following terms and conditions:
- Purchase Obligation: By clicking the "buy now" or "make an offer" button and paying the 1% deposit, you acknowledge that you are entering into a legally binding agreement with the seller. This agreement obligates you to purchase the property at the agreed-upon price and under the terms specified in the listing.
- Property Inspection: It is your responsibility to thoroughly review the property details, perform any necessary inspections, and ensure that the property meets your requirements before proceeding with the purchase. You can even request live video tours and professional inspections to aid in your decision-making process.
- Deposit Payment: The 1% deposit you pay indicates your serious intent to purchase the property. This deposit is non-refundable except in cases where the seller fails to fulfill their obligations or if otherwise specified in the agreement. Please note that the 1% deposit paid by the buyers is equal to Homebourse service fee, which will be deducted from the price agreed upon. The fee is calculated from the asking price, disregarding the final price of the offer you agree with the buyer. Homebourse offers an 8-day free cancellation policy, allowing you to visit the property in person and request a full refund for your deposit during this period.
- Completion of Transaction: Upon paying the 1% deposit, you are committed to completing the transaction as agreed upon with the seller. You must cooperate and provide any necessary information or documentation promptly to facilitate the transaction's successful conclusion.
- Legal Compliance: You agree to comply with all applicable laws, regulations, and local requirements related to the purchase of the property.
- Dispute Resolution: Homebourse will not be held liable for any disputes or issues that may arise between you and the seller. It is your responsibility to communicate openly and resolve any disagreements in a fair and lawful manner.
- Privacy: By using Homebourse.com, you acknowledge that you have read, understood, and agreed to our Privacy Policy, as outlined in the General Terms of Use. This policy explains how we collect, use, and disclose your personal information when you use our platform. It is important that you read and understand this policy, as it outlines how your data is handled.
- Listing Removal: In the event that the seller fails to fulfill their obligations or if there are any concerns regarding the listing's accuracy or legitimacy, Homebourse reserves the right to remove or suspend the property listing.
- Financial Responsibility: You acknowledge that any financial transactions or arrangements made between you and the seller are your responsibility, and Homebourse is not liable for any monetary losses incurred during the transaction. Please note that the 1% deposit paid by the buyers is equal to Homebourse service fee, which will be deducted from the price agreed upon. The fee is calculated from the asking price, disregarding the final price of the offer you agree with the seller. You also, acknowledge that the fees of the law firms and title companies involved in the closing process are not included in Homebourse's fees.
- Modification of Terms: Homebourse reserves the right to modify or update these terms and conditions at any time. It is your responsibility to review the agreement periodically and remain aware of any changes.
By proceeding with the purchase on Homebourse, you affirm that you have read, understood, and accepted all the terms and conditions outlined in this agreement, including those specified in the frequently asked questions section. Failure to comply with these terms may result in the termination of your account and removal of your access to the platform.
Seller Agreement
- Property Listing: You certify that you are the lawful owner or authorized representative of the property you are listing. You are responsible for providing accurate and up-to-date information about the property, including its description, price, location, and any other relevant details.
- Binding Commitment: By accepting this policy, you acknowledge that if a potential buyer indicates their willingness to purchase your property at the asking price by paying the 1% deposit, a binding contract will be established between you and the buyer. This contract will create a legal and binding sales obligation for you.
- Accurate Representation: You agree that all information provided in the property listing is accurate and not misleading. Any false or deceptive representation may result in the removal of your listing and potential legal consequences.
- Transaction Completion: Upon accepting an offer from a buyer who has paid the 1% deposit, you are committed to completing the transaction in good faith, adhering to the terms agreed upon.
- Seller's Obligations: As a seller, you are responsible for cooperating with the buyer and providing all necessary documents and information required to facilitate the transaction promptly.
